Condo Owners Gain Exemption for Rental and Lease Restrictions after January 1st 2012

Effective on January 1, 2012, an owner in a common interest development (i.e. a condominium building) is exempt from any prohibition in a governing document against renting or leasing his or her unit, unless the restriction was in effect before the owner acquired title to the unit. This new law was codified as Civil Code §1360.2. Under this code, Owners could  still consent to such a restriction, though it is unlikely to be very common for an owner to give up their rights to rent out their unit.
