California Small Claims Jurisdication Increases

Effective January 1, 2012, the Small Claims Court jurisdiction increased from $7,500.00 to $10,000.00 for a lawsuit brought by a natural person.  See, C.C.P. Section 116.221.  The limit for a corporation or other entity remains at $5000.00.  See, C.C.P. Section 116.220.  For a specific claim of bodily injury from a car accident, and only if the defendant is covered by an automobile insurance policy with a duty to defend, then the limit is in between at $7,500.00.  See, C.C.P. Section  116.224, which sunsets or expires in 2015, meaning the increase to $10,000.00 would not become effective until 2015 under the law as it is written now.
